TURN Reusable Cup Instant Win Game Official Promotion Rules

NO PURCHASE IS NECESSARY TO PLAY OR WIN. Participation constitutes the participant’s full and unconditional agreement to and acceptance of these Official Rules (https://turnus.in/policies/terms-of-service). Open to legal residents of the state of California at the time of Game Play who are at least 18. The TURN Reusable Cup Instant Win Game (“Game”) begins on August 14, 2023 and ends on October 22, 2023 (the “Game Play Period”). Odds of winning depend on the number of eligible entrants and Prizes remaining at the time of entry during the Game Play Period. The Game is sponsored by TURN Systems Corporation (“Sponsor”) All Games are governed by these Official Rules, which are identical for each Game.

ELIGIBILITY: The Game is open to natural persons eighteen (18) years of age or older who are legal residents of the state of California at the time of Game Play. Employees, officers, and directors of Sponsor and Starbucks Corporation (“Promotional Party”), and each of their respective parents, subsidiaries, members, divisions, affiliates, advertising, promotion, and fulfillment agencies and those individuals who are immediate family members of Sponsor and Promotional Party, or persons living in the same household as Sponsor and Promotional Party, are not eligible to participate in the Game. “Immediate family” means parents, domestic partners, siblings, children, and spouses. Void where prohibited. All federal, state, and local laws and regulations apply.

HOW TO PLAY: To enter the Game, you must visit one of the Starbucks stores identified in Schedule 1 (“Participating Stores”) and obtain a specially identified reusable Starbucks cup (“Reusable Cup”) by either a) making a beverage purchase or b) requesting an ice water at no charge. Once you have obtained a Reusable Cup, scan the QR code on the Reusable Cup with your mobile device, and provide your phone number once prompted. Then, once you have finished your drink, return the Reusable Cup in the designated “Smart Bin” at any participating Starbucks store located in California, as shown in Schedule 1. Returning the Reusable Cup to a designated “Smart Bin” after scanning the QR code and providing your phone number during the Game Play Period will result in one (1) Game play.

There is a limit of ten (10) Game Plays per person/phone number, per day, during the Game Play Period. For example, if you enter ten times by returning ten Reusable Cups on August 14, 2023 as described above, you may continue to return Reusable Cups on that day, but any cup returns in excess of ten on August 14, 2023 will not count as Game Plays. You will, however, be eligible to enter again starting on August 15, 2023.

No other methods of game play are accepted. Sponsor and Promotional Party are not responsible for incorrect, inaccurate, or incomplete game play of information by participants; lost game plays or transmissions, interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic, technical malfunctions or the computer hardware, software, or any combination thereof; or problems associated with any virus or any other damage caused to participants’ systems.

PRIZES, ODDS

 35,318 total Prizes are available to win during the Game Play Period.  Each prize is a Starbucks e-gift card ranging in value from $5 to $250  (“Prize”).  Standard e-gift card terms and conditions apply.  Total prize ARV: $200,000.  

Odds of winning a Prize depend on the number of Prizes remaining at the time of entry during the Game Play Period. If you are the first to submit a Game Play at a randomly selected winning moment, as determined and verified by Sponsor, or if no one submits a Game Play at such moment, if you are the first to play immediately after such moment, as determined and verified by Sponsor, you will be deemed the winner. If you are a winner, Sponsor will send you a text message stating that you have won as described in the Selection of Winners section of these Official Rules.

Limit (3) Prize per person per day. The number of prizes available to be won will diminish as they are awarded. Unclaimed Instant Win Game Prizes will expire after 7 days. Expired prizes will be reallocated to the unawarded prizes list. ONCE ALL PRIZES ABOVE HAVE BEEN AWARDED, THE GAME WILL CONCLUDE.

All prizes will be delivered digitally. No substitution or transfer of any prize or election of cash in lieu of any prize by the Winner will be permitted. Sponsor reserves the right to substitute any prize of equal or greater value. Prizes are non-transferable. All federal, state, and/or local taxes are the sole responsibility of Winner.

Winners and guests must abide by all store policies. Sponsor reserves the right to revoke full or partial prize from any winner or winner’s guest who they or store personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any store policy or law, or may bring Sponsor into disrepute. Winner will be issued an IRS 1099-MISC tax form for the prize retail value, if applicable. A prize winner may be required to execute an Affidavit/Release form prior to the prize being released to such winner. Winner agrees to provide Sponsor with any such tax documentation as it may reasonably request and as required by federal, state, or local tax law, including but not limited to IRS tax form W-9. Winner also agrees to provide Sponsor with any additional information it may reasonably request to validate winner’s identity, including but not limited to a copy of a winner’s driver’s license, social security card, passport, and/or other valid government-issued identification.

At Sponsor’s sole discretion: If it is discovered during prize verification that you have played, attempted to play, or used multiple accounts to play more than the stated limit, you will be disqualified at the discretion of the Sponsor, or your Game Play will be void. Game Play generated by script macro or other automated means, which subvert the game play process, is void. Any Game Play that Sponsor determines to subvert or undermine either these rules or general principles of fair game play shall be void. All Game Plays become the property of Sponsor and will not be acknowledged or returned. Sponsor and Promotional Party are not responsible for late, lost, stolen, damaged, delayed, or undelivered prizes.

SELECTION OF WINNERS:

Participants will be notified if they are potential winners via text message. The potential winner will claim their prize by clicking on the prize redemption link sent via text message, following the on-screen prompts, and providing all of the required information. If you are not notified that you have won before the end of the Game Play period, you are not a winner.

Carrier specific charges for text messages may apply, depending on your individual cellular pricing plan, in accordance with your cellular customer agreement.

ALL PRIZES MUST BE CLAIMED BY POTENTIAL WINNERS DURING THE GAME PLAY PERIOD.  In the event of a dispute over the identity of the selected Winner, the Winner will be deemed to be an Authorized Account Holder of the phone number and/or email address used at registration. With respect to any email address used, an “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an internet service provider, online service provider, or other organization (e.g business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to deliver the notification to selected Winners. By accepting and/or using prize, Winner gives Sponsor the right to use Winner’s name, voice, and/or likeness for the purpose of inclusion on a Winner’s List, and in advertising, trade, or promotion, without further compensation worldwide in perpetuity and in any form of media including the Internet, unless prohibited by law

OTHER CONDITIONS: By participating in the Game, participants agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final. Sponsor and  Promotional Parties, agents and representatives of Sponsor and  Promotional Party, and each of their respective parent companies, members, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, employees, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, internet, or computer malfunctions, failures, or difficulties of any kind: (ii) failed, incomplete, garbled, or deployed computer transmissions; (iii) any condition caused by events beyond the control of the Sponsor that may cause the Game to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of any prize, or acceptance, possession, or use of any prize, or from participation in the Game; or (v) any printing or typographical errors in any materials associated with the Game. Sponsor reserves the right, in its sole discretion, to suspend or terminate the Game at any time if a computer virus, but, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of the Game. Sponsor reserves the right to cancel the Game or change any element thereof, with or without notice, at any time, due to printing errors, website errors, transmission errors, or other mistakes or problems in the production or administration of the Game. Sponsor reserves the right to cancel the Game or a Game duration for any reason, provided that it does so in advance of the Game Play duration. Sponsor also reserves the right to disqualify, in its sole discretion, any person tampering with the game play process, the operation of the website, or who is otherwise in violation of the rules. By participating participants agree that all disputes will be resolved in the appropriate courts in the state of Delaware, exclusively, and subject to the laws of the state of Delaware.

By participating in the Game, each participant agrees to release and hold Sponsor and Promotional Party, and each of their employees, officers, directors, shareholders, successors, assigns, agents, representatives, parents, members, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Game or resulting from acceptance, possession, or use of any prize including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Game Plays become the exclusive property of the Sponsor and will not be returned.

PARTICIPANT’S PERSONAL INFORMATION: Information collected from participants is subject to TURN’s Privacy Policy which can be found at www.turnsystems.co/privacy-policy. By participating in this Game, you agree to the use of your personal information as described in the above Privacy Policy.

Requests must be received no later than thirty (30) days following the end of the Game Play Period.

This Game is in no way administered or sponsored by Starbucks Corporation. Sponsor is solely responsible for the execution and administration of the Game.  Any inquiries regarding the Game should be directed to the Sponsor.
